발달장애인을 위한 공공후견인의 경험에 관한 연구

Abstract

이 연구는 발달장애인을 위한 의사결정지원제도로 성장하기 위해 공공후견의 본 모습을 탐색하고자하는 목적을 가지고 수행되었다. 공공후견은 공공후견인의 실천으로 구성되므로 실제 후견 경험을 연구하기 위해 Creswell의 질적 사례연구 방법으로 후견사례 9건을 살펴보았다. 연구 결과 공공후견인들의 경험은 ‘기대와 온정으로 뛰어들기’, ‘예상치 못한 실패와 갈등의 경험’, ‘지속을 위한 거리두기’ 로 구성되는 동적인 과정임을 알 수 있었다. 공공후견은 대부분 사회복지실천가가 기대감이나 이타심을 바탕으로 적극적인 개입활동으로 시작하였다. 그러나 갈등과 어려움 등 부정적 경험을 통해 변화의 지점을 맞이하게 되고, 그 결과 본인이 감당할 수 있는 일정한 정도를 찾고 그 간격을 유지하면서 후견활동의 지속을 하는 것으로 나타났다. 후견인의 적극적 개입은 피후견인의 자기결정과 후견활동 안정성에 영향을 미칠 수 있으므로 후견법인 및 발달장애인센터는 선임 후 후견인, 피후견인과 함께 임무의 범위와 해석 등 후견활동에 대한 실질적 논의를 해야 한다. 또한 자주 접하게 되는 주거래 금융기관 등 외부와 연계를 통해 후견인의 어려움을 완화시키는 것도 필요하다. 마지막으로 개별적으로 이루어지는 후견활동을 오픈시킬 수 있는 간담회, 자조모임 등을 활성화하여 후견활동의 공개와 공유를 통해 모니터링과 배움이 자연스럽게 이루어지는 기회로 삼아야 할 것이다.

The purpose of this study was to explore public guardianship to grow into a decision making support system for the developmental disabled. Public guardianship consists of practitioners’ practices, so researching actual guardian's experience is an indispensable prior work. In order to study, we examined nine cases in the K local government by qualitative case study method. Based on the data of within-case analysis and across-case analysis showed three major themes of the experiences of public guardians. These were ‘jumping with expectation and warmth’, ‘experience of unexpected failure and conflict’, and ‘keep a distance for continuity’. In the early stage, emotional aspect of human relationship led to more active intervention. These overactive interventions can lead to the point of change through the negative experience of conflict and difficulty. As a result, there was a risk of keeping distance that a certain level can afford. Since early active intervention may affect the self-determination, the guardian and support center should conduct a practical discussion including the scope and interpretation of the duties. In addition, it is necessary to alleviate the difficulties by linking with the community like a bank. Finally it is necessary to activate meetings with support organizations and self-help groups. This will be an open opportunity for monitoring and learning to take place naturally.
