- 담배제품불법거래 근절에 관한 의정서에 대한 비준 준비 및 국내이행을 위한 법적 제도적 실행방안 마련

purpose of this study was to develop countermeasures to protocol to
eliminate illicit trade of tobacco products and review results of selected
agenda of the fifth Conference of the Parties to the WHO Framework
Convention on Tobacco Control.
The protocol was based on the article 15 of the WHO Framework convention
on Tobacco Control. The protocol was adopted by the fifth
Conference of Parties held in Seoul, November, 2012, and the Republic of
Korea has signed the protocol. Authors reviewed background of the protocol,
collected examples of law related to regulating trade and illicit trade of tobacco
products.
For the purpose of controling supply chain of tobacco products, the protocol
requires parties to implement a licence system. By the Tobacco Industry
act in the Republic of Korea, tobacco manufacturers are required to get licence
from the central government. Importers and wholesale and retailers of
tobacco products are required to register at the local government. This system
has control over due diligence, record keeping and security of business
of tobacco products. Sales of tobacco products through internet is prohibited
in Korea.
Korean supply chain control system does not have a tracing system yet. It
is required by the protocol article 8 to implement a form of markings on all
unit of packets and packages of cigarettes within five years of entry into
force of the Protocol to that party. Trade of tobacco products with no
marking of taxation is to be considered as an unlawful conduct by the
protocol. So the government has to implement a new system of marking for taxation upon ratification of the protocol.
The article 12 of the protocol requires implementation of effective ways
of controlling tobacco products in free zones and prohibition of intermingling
of tobacco products with non-tobacco products in a single container or any
other such similar transportation unit at the time of removal from free
zones. Intermingling tobacco products with non-tobacco products is also considered
as an unlawful conduct (Article 14). So the government has to adopt
this new policy upon ratification of the protocol.
Authors reviewed results of the fifth Conference of the Parties to the
FCTC. The COP5 adopted a new principles for the implementation of the article
6, price policy for tobacco products. The COP5 also adopted partial
guidelines for the article 9 and 10. This adopted partial guideline includes
guidelines of public disclosure of tobacco products and Reduced Ignition
Propensity cigarettes. This may increase public awareness and safety of the
tobacco products. It has been found that there are still many debates left
with regard to issues of economic transition of tobacco growing and
Electronic Nicotine Delivery system and needs more evidenced based
research.
