dc.description.abstract	경제협력개발기구(OECD) 국가 가운데 국가 단위의 법정 상병수당 제도가 없는 나라는 한국과 미국 두 나라뿐이다. 미국에서는 연방 단위의 상병수당을 도입하려는 시도가 역사적으로 계속 있었지만 의회에서 번번이 좌초됐다. 이에 따라 연방과 일부 주에서 다소 변형된 방식의 상병수당 제도가 복잡하게 운영된다. 연방에서는 12주의 법정 무급병가인 가족의료휴가(Family and Medical Leave)가 보장된다. 또 연방정부의 행정명령에 따라 연방정부와 계약관계가 있는 기업을 대상으로 1년 최대 56시간의 유급병가가 집행된다. 연방 단위의 상병수당이 없는 상황에서, 16개 주 및 워싱턴 D.C.에서 대략 최대 40시간의 유급병가가 강제된다. 또 9개 주와 워싱턴 D.C.에서는 사회보험 형태의 상병수당을 운영하고 있다. 이 글에서는 미국의 제도적 현황을 점검하고, 그에 근거해서 한국에 던지는 정책적 함의를 검토했다. 이를테면, 한국에서 상병수당을 도입하기 위해서는 아픈 노동자가 쉴 수 있는 권리의 법적인 보장이 선행될 필요가 있음을 강조했다.
dc.description.abstract	Of all OECD countries, only Korea and the US lack a national sickness benefit scheme. In the US, there have been continued efforts at the federal level to implement sickness benefit programs, but they have repeatedly been stalled by Congress. As a result, the federal government and some states run their own sickness benefit schemes in different ways. The federal government guarantees Family and Medical Leave (12 weeks of unpaid sick leave). Also, under a federal executive order, businesses that are in contractual relationships with the federal government are required to provide their employees with up to 56 hours of paid sick leave annually. In 16 states and Washington D.C., sick leave of around 40 hours is mandated in the absence of a federal sickness benefit scheme. Additionally, nine states and Washington D.C. offer sickness benefits as part of social insurance. This article examines sickness benefit programs in the US and discusses the implications they have for Korea. For example, this article suggests that in order to implement a national sickness benefit scheme in Korea, sick workers’ right to rest must be legally guaranteed.
