| dc.description.abstract | 지난 3월 6일 국회를 통과하고 4월 10일 공포된「장애인차별금지 및 권리구제 등에 관한 법률」(법률 제8341호)는 장애계의 오래 숙원을 달성한 역사적인 법이자 우리 사회의 인권을 한단계 성숙시킬 중요한 계기가 될 것이다. 장애인차별금지법은 직접차별, 간접차별, 정당한 편의 제공거부, 광고에 의한 차별 등 4대 차별행위를 금지하고 있으며, 이 4대 차별행위를 고용, 교육 등 6대 영역에 대해 적용하고 있다. 또한, 여성장애인과 장애아동, 정신적 장애인에 대해서는 별도의 규정을 두고 있다. 그리고 국가인권위원회 내에 장애인차별시정소위원회를 두도록 하고 악의적인 차별에 대해서는 법무부장관의 시정명령도 규정하고 있다. 장애인차별금지법은 분명 하나의 중요한 계기이지만 그것이 실효성을 발휘하기 위해서는 법 내용과 관련된 여러 쟁점들을 사회적 합의를 통해 풀어나가는 과정이 필요하다. |
