| dc.description.abstract | 본 연구는 사회보장수급권 실효성 차원에서 북한이탈주민의 제도 접근성 문제를 비판적으로 조명한다. 검토 결과, 충분한 수준의 사회보장수급권이 보장된다고 보기 어려운 법적 쟁점들이 존재한다. 급여대상 측면에서, 북한이탈주민의 외국 국적 불인정과 제3국 출생자녀 지원배제, 학력과 자격에 대한 제한적 인정 등의 쟁점이 있다. 급여구성 측면에서, 북한이탈주민의 보호 및 지원에서 약한 국가 책임성과 더불어 세부 내용에서 북한이탈주민 보호기간과 소득보장 적절성 측면에서의 문제가 있다. 급여제한과 권리구제의 측면에서, 절차적 권리의 미비로 인한 사회보장 배제의 가능성이 있다. 본 연구 결과를 토대로 사회보장법 연구에서 통일 인지적 관점과 북한이탈주민에 대한 포용적 정책이 확산되기를 기대한다. |
