| dc.description.abstract | 2000년 이후 북한 사회복지 입법 동향은 북한의 사회복지에 대한 인식과 행태를 반영하고 있다. 또 이러한 북한의 입법 동향을 분석하면, ‘대상별 법적 분화’가 나타나고 있다. 이는 과거 북한 사회복지법제의 경우 북한이 대상별 통합적인 법제를 추구하는 행태와 정반대의 태도이다. 즉, 북한의 사회복지 관련 입법행위는 대상별로 독립적인 입법화를 추진하여 북한도 사회적 약자인 장애인, 노인, 아동, 여성에 대한 제도적 장치를 완비하였다고 하겠다. 북한은 당면한 대내적인 환경과 맞물려 추동한 결과, 다수의 사회복지관련 법령들을 제정하게 되었다고 판단된다. 이는 북한의 복지환경과 복지인식 사이의 작용과 반작용의 상관관계에 기인한 결과로서 ‘입법화’로 승화되었다. 북한 사회복지법제는 요보호대상별로 법적 분화가 시작되었고 이로 인해 개별 독립화된 법령들이 나타나기 시작하였다. 따라서 이는 기존과 다른 행태이고 이는 결국 북한 사회복지의 법제적 ‘현대화’를 의미하고 있어 큰 의의가 있다. 북한 사회복지법제의 양적이고 질적인 발전을 일으켰고 종국에는 과거보다 한 차원 높은 법적체계를 형성하였다. 이 때문에 북한의 이러한 행태가 지속되는 한 적어도 제도적 측면에서 발전은 일정 부문 지속되리라는 전망이 가능하다. 따라서 북한 사회복지법제 전체를 놓고 볼 때, 북한의 2000년 이후 입법 동향은 상당부문 의미하는 바가 크고 이는 결국 북한사회복지법제 동학의 과거와 현재를 구분하는 판단기준이 된다. Trends in North Korea’s social welfare legislation since 2000 reflect its changing perception and attitudes toward social welfare. Analysis of the legislation trends shows ‘legal differentiation by target group.’ This trend is opposite of North Korea’s past legislations, where its social welfare legislation showed an integrated legal approach to target groups. In other words, North Korea’s social welfare legislations now differentiates various target groups to establish systemic mechanisms in protecting its socially vulnerable population, such as the disabled, elderly, children and women. It is estimated that this change in legal behaviors has resulted from various internal circumstances North Korea faces. North Korea’s internal circumstances surrounding social welfare and its changing perceptions have combined to sublimate into its ‘legislation.’ Its social welfare legislation started to differentiate between target groups and in turn produced separate laws for different groups. This indicates a significant change in North Korea’s social welfare which would mean an ‘advancement’ in its legislation. The development in North Korea’s social welfare legislation is both quantitative and qualitative. It is possible also to presume that this development in legislation will continue in North Korea. Given its significance, North Korea’s social welfare legislation trends since 2000 will provide a standard upon which the dynamics of North Korea’s social welfare’s past and future can be judged. |
